Can I get my criminal record expunged or sealed?

In Texas there are only two types of cases that can be expunged. In a criminal court, the case has to have been either dismissed or the person was found not guilty in trial. If the case has been resolved by a plea bargain, there are different remedies depending on the sentence.

If you are given the sentence of a deferred adjudication probation and have finished the deferred, you may be eligible for a Petition for Non-Disclosure.

If you served jail time or prison time, your case can not be expunged or removed from your record. It does not matter how long ago you were convicted - you will not be able to expunge it in this situation.
