Details:

Edward and Margaret Tateosian sued the State of Vermont on a governmental tort claim theory for the injuries and damages they sustained when a steel pole 4 feet long and 6 inches wide fell off of a State Transportation Agency truck driven by Wendell Johnson and struck the windshield of the Tateosian's 1994 BWM. The pole hit Mr. Tateosian's hand and broke the steering wheel causing him to loose control of the vehicle. His injuries required to surgeries to repair and it took nearly three months for him to regain full use of his hand. The Tateosians claimed that they State knew that chain guards on its trucks were dangerous but did nothing to replace them until after Mr. Tateosian was injured. Plaintiffs' verdict for $310,000.00.
