Details:
Rearend automobile truck accident in which Jeff McSorley was paralyzed from the chest down, his 5-year-old daughter was killed and another daughter and his ex-wife were injured. The trucking company settled all of the claims except for Mr. McSorley's. The trucking company claimed that he caused the accident when he changed lanes and lost control of his car just before the accident. McSorley claimed that the truck driver was negligent, alleging that he didn't hit his brakes until he was about 10 feet from the car. The plaintiff also alleged that the truck driver was under the influence of diazepam, a drug taken for a nerve problem in his leg, and might have been fatigued.
