If you feel your lawyer is not doing his or her job in representing your interests, the case is not moving along fast enough, he or she is not returning your calls or you are just uncomfortable and want to change lawyers,  you have every right to do this at any point in the process.

Here is all you need to know to change attorneys:

  1. You can change your attorney at any time—even today! You do not need to give your attorney any notice.
  2. You do not need to worry about confronting your old lawyer. Find a new lawyer (you can get referrals from legal sites like Nolo.com, Avvo.com and Martindale.com) and have them break the news. They will send your former attorney a letter to notify them that you have terminated their services and hired a new lawyer.
  3. There are no new agreements or fees with a new lawyer. All lawyers who work on your case, if they are entitled to any payment, will share the fee in your initial agreement. You do not need to even be concerned in how they split the fee—if they can’t come to an understanding then a court will make the decision.
  4. Changing lawyers should not cause any delay in your case. If both lawyers are civil, then your old lawyer will send the file to the new lawyer and that is all you need to do.

Remember, as the client you are the boss and your lawyer works for you. If you don't like them for any reason--they don't return your calls, they talk down to you or you just don't think they are doing a good job, then it’s over.
