It is difficult for people who have not been injured by the wrongful

during their later years, find out that the neglect or abuse of their

Most claims, of course, are paid for by insurance. When insurance
companies do not act in good faith toward their insured in adjusting
insurance claims (an all too frequent occurrence) they can be held
legally responsible by making a bad faith claim. Because an insurance
company has an economic incentive to place the company’s financial
interests ahead of its contractual obligation to properly investigate,
fairly evaluate, and pay valid claims, the law allows an insurance
company which has failed to properly handle a claim to be held liable
for bad faith. Unfortunately, it is to usually necessary hire a lawyer
and file a law suit against the insurer the only way to hold an
insurance company acting in bad faith accountable for its actions. In
fact, unless ordinary citizens are allowed to file lawsuits when they
have been wronged by the rich and powerful, the rich powerful would
have no incentive to do the right thing.
