Case History
DEPORTATION REVERSED AFTER REMOVAL FROM THE UNITED STATES
Practice Area: Immigration Law
Description: After having been deported from the U.S. and after submitting himself to the custody of the Bureau of Citzenship & Immigration Service, the individual was placed on a plane and sent back to his home country. The entire process was completed in less than two days and as such, he was denied his right to a trial.
Outcome: Teplen & Associates argued that the actions of the U.S. Government were in violation of his due process rights. Our firm was able to arrange for his immediate return to the U.S. and for the eventual termination of his removal proceedings, allowing him to become a lawful permanent resident and obtain his "Green Card."
CITIZENSHIP GRANTED TO GREEN CARD HOLDER WITH CRIMINAL RECORD
Practice Area: Immigration Law
Description: After returning to the country after a brief absence, the Bureau of Citizenship & Immigration Services began removal proceedings against a permanent resident, based upon a criminal conviction dating back over twenty years.
Outcome: Teplen & Associates applied to the Federal Courts to adjudicate the case. A Federal judge ruled that the individual was eligible for naturalisation and removal proceedings were terminated.
ABUSED SPOUSE GRANTED PERMANENT RESIDENCE AFTER BAD COUNSEL
Practice Area: Immigration Law
Description: Local counsel had advised an abused spouse, who had self-petitioned for lawful permanent residence, to depart the U.S. voluntarily. She was told that since she had remarried and the abuse no longer existed, her application would be denied.
Outcome: Teplen and Associates devised an entirely new strategy, but still based upon the initial petition. Three weeks later, the client was granted lawful permanent residence: a "Green Card."
DEPORTATION AVOIDED DESPITE MULTIPLE CRIMINAL CONVICTIONS
Practice Area: Immigration Law
Description: A client with a history of multiple criminal convictions and arrests was placed in a Federal detention facility, while awaiting deportation.
Outcome: In order to prevent his immediate removal, Teplen & Associates filed for and had approved a writ of habeas corpus. This application, filed in the Federal District Court, allowed the client to remain in the U.S. while seeking a remedy for his immigration problems. Had the individual been removed, he would have been prevented from entering the country for a minimum of ten years.
SMUGGLED ALIEN GRANTED PERMANENT RESIDENCE
Practice Area: Immigration Law
Description: A Chinese national had fled his home in Mainland China, with the help of a "snakehead"- someone who smuggles illegal aliens in to the U.S. The Law states that entering the U.S. without inspection or on a false passport is grounds for automatic denial of ANY immigration application.
Outcome: Teplen & Associates successfully argued, that the teenager should not be punished for the actions of the "snakehed." Since he was not an adult, he did not possess the knowledge or understanding, to commit visa fraud. The judge ruled that the child be allowed to adjust status and become a lawful permanent resident.
TRIUMPHANT WIN ON APPEAL OF DENIAL
Practice Area: Immigration Law
Description: A Spanish national fought to remain in the U.S. in order to obtain the best medical care for his disabled child, who was a U.S. citizen. Our firm, zealously argued the case for the child, explaining the extreme medical hardship forced upon the child, if the parent was returned to Spain.
Outcome: Teplen & Associates, who prepared the answer on the initial deportation, triumphed, with an appeal on the denial. The client was granted a waiver and was able to apply for his "Green Card." The U.S. born child was able to receive the necessary medical care, in the U.S.
PAST CRIMINAL CONVICTION OVERTURNED

Description: Teplen & Associates sought to re-open a closed criminal matter, dating back over twenty years. The original criminal conviction was preventing a French citizen from obtaining a visa to come to the U.S. Even the most minor of infractions can destroy all and any, future immigration options. Laws regarding the issuance of visas to those with criminal convictions, are strict and very rigid.
Outcome: Teplen & Asscoiates sought to reopen the matter and negotiated a new plea to be entered for a different crime, so that a conviction record would not adversely affect immigration.
ASYLUM GRANTED AFTER IDENTITY CONFUSION
Practice Area: Immigration Law
Description: A client of the Democratic Republic of the Congo (DRC) had been both tortured and detained by the government. He faced further obstacles to asylum after the UNHCR confused his identity with that of someone else, from the Republic of Congo.
Outcome: Teplen & Associates successfully argued his case to resolve the confusion over his identity, The client was granted both asylum status and was also able to file his application for a "Green Card."
TEACHER PERMITTED EXTENSION OF STAY AFTER VISA EXPIRES
Practice Area: Immigration Law
Description: A teacher retained the firm, one before the expiration of her H-1B work visa; a visa subject to a six year limit.
Outcome: Teplen & Associates argued that she be re-allocated the time spent in her home country during the lenghty vacations, afforded by the academic years, spanning the entire six year peiod. The teacher was granted an additional year in H-1B status allowing her to apply for a "Green Card" and stay indefinitely.
WAIVER OBTAINED FOR PERSECUTED IRANIAN
Practice Area: Immigration Law
Description: An Iranian national feared persecution when he returned to his home country, in order to obtain an 'O' visa. Granted only to those individuals of extraordinary ability, the client had, in the past, been active in the oppositon movement in Iran
Outcome: Teplen & Associates successfully argued for a waiver based upon the client's claim of possible persecution. Enlisting the assistance of the former Iraninan Ambassador, who testified on the client's well-founded fears of persecution, our firm was able to obtain a waiver for the client, who was also able to apply for his "Green Card."
