Sales Assistant wins disability retaliation case
Practice Area: Employment
Description: FOR IMMEDIATE RELEASE 12-23-08 A 55 year old woman, who was fired three Christmases ago after requesting accommodations for severe allergies, has won her disability retaliation case in Houston Federal Court. A jury found that David Powers Homes, Inc. violated the Americans with Disabilities Act (ADA) by terminating the employment of Pamela Miles-Hickman because she requested accommodations under the ADA. Hickman worked as a sales assistant in the Crighton Ridge new homes subdivision of David Powers Homes in Conroe. She informed her employer that she needed accommodations for severe allergies and chemical sensitivities. Hickman testified that 15 days after making her formal request for accommodations, she was terminated. According to Hickman’s attorney, Steve Petrou, David Powers Homes claimed that Hickman “voluntarily resigned” because she failed to notify her supervisor that she was having a colonoscopy on December 16, 2005. However, the jury found she was retaliated against for asking for disability accommodations. The federal court jury awarded Hickman $75,000 in back pay and $100,000 in emotional distress damages. The verdict was delivered late Friday evening, December 19, 2008. Federal Judge Nancy Atlas has received the verdict, but will not be entering a final judgment until post trial motions are submitted.
