Benjamin Allens practice covers all aspects of intellectual property law as well as security clearance, export control, and aviation law.
Mr. Allen is a private pilot and has been flying since 2000. In law school, Ben worked on large cases involving serious aviation crashes for the Aviation and Admiralty Section, Civil Division, U.S. Department of Justice. He is also a panel attorney with the Aircraft Owners and Pilots Association (AOPA) Legal Services Plan, defending pilots accused of violation of Federal Aviation Regulations before the Federal Aviation Agency (FAA) and National Transportation Safety Board (NTSB).
Mr. Allen counsels clients on effectively protecting their intellectual property rights through trademark and copyright registrations, representing clients in infringement actions when necessary. Mr. Allen was a software engineer with Lucent Technologies Bell Labs and has over 15 years experience in software development. He leverages that expertise when working with developers and inventors to ensure their rights are fully protected through copyrights, trade secrets, and patents.
Prior to joining The Marbury Law Group, Mr. Allen worked at the U.S. Patent and Trademark Office as a trademark attorney and staff attorney. There, he examined thousands of federal trademark applications and reviewed identification and classification issues, and represented the United States on the Committee of Experts of the Nice Union at the World Intellectual Property Organization in Geneva, Switzerland. He now draws on that experience to prosecute federal trademark applications and to manage domestic and global trademark portfolios.
Mr. Allen also advises individuals and companies seeking to obtain or maintain national security clearances including representing clients before intelligence agencies such as the Defense Office of Hearings and Appeals (DOHA).
Additionally, Mr. Allen assists clients, including multinational companies, to effectively develop and implement export compliance programs, including securing licenses for ITAR- and EAR-controlled exports.

Dr. Roberts, Senior Partner of the Firm, practices in security clearance law, patent, copyright, trademarks, and litigation related to these areas. He is extensively involved in invention protection, business counseling, start-up advising, export control issues, qualifying personnel for security clearances, and helping companies deal with Foreign Ownership Control and Influence (FOCI) matters. Dr. Roberts also provides litigation support to other law firms in the form of patent opinions, including appellate work, to clients in federal and state courts in all of these areas. Dr. Roberts meets with patent and trademark examiners to resolve issues affecting approval of applications.
Dr. Roberts possesses active Security Clearances and regularly represents clients before Defense Office of Hearings and Appeals (DOHA) and other intelligence agency Administrative Boards regarding security clearances at all levels. Dr. Roberts negotiates with senior level officials of U.S. Departments of State, Commerce, Treasury, and Defense regarding export applications and licenses. He also interacts with senior level officials of Department of Justice and Office of U.S. Trade Representative to enforce client rights in intellectual property around the world. Finally, Dr. Roberts is also extensively involved in software contracts (drafting and negotiation), and contract drafting concerning hardware and software development.
Dr. Roberts has extensive corporate and government agency experience. He was the senior staff scientist and project director of a large government system integration project and discharged the responsibilities of principal research scientist in applications of artificial intelligence with General Electric Company, Space Systems Division. His varied government agency experience includes managing numerous research efforts in the areas of software and hardware development, imaging systems, and mapping; high performance aircraft sensor system operator; image exploitation software development program manager; and interagency work related to remote sensing.
