I first got involved in disability benefits law when I helped my cousin overturn a long-term disability denial eventhough she was diagnosed with and suffering from brain cancer. What I learned during that process motivated me to focus my efforts and energies in helping others like her fight for their benefits.

Case History
Fully Favorable SSDI - 37 year old female
Practice Area: SSDI
Description: My client was a 37 year old female, mother of three who was denied on her initial application. She suffered from severe back, neck and arm pain as well as neurological issues. She had an extensive treatment history dating back at least 8 years.
Outcome: I worked with her treating neurologist to obtain a medical source statement indicating the significant limitations on my client. Her neurologist indicated that she would miss at least 4 days of work per month due to her medical condition and probably be off task at least 25% of the time. I submitted this medical source statement along with a pre-hearing brief in advance of the hearing. At the hearing, the ALJ asked a few confirmatory questions of my client and then posed a hypo to the VE including all of the limitations set forth on the medical source statement. The VE indicated that the client could not work in any occupation with the stated limitations. The ALJ told us during the hearing that she was granting a fully favorable decision. We received the decision about 2 weeks after the hearing.
Long-Term Disability Settlement - 58 year old male

Description: My client was on long-term disability benefits that he received through his employment. The benefits were initially awarded due to my client's significant back pain. My client had an extensive treatment history and tried numerous conservative treatment options, but found no relief. The long-term disability company initially found the client disabled under the policy. However, after the definition of disability changed, they found the client able to work in another occupation.
Outcome: After appealing the decision of the long-term disability company, I was able to get my client back on his long-term disability benefits. However, he now had a significant overpayment issue due to his receipt of SSDI benefits. Working with my client and the long-term disability insurance company, we were able to reach an agreement on a lump sum buyout of the remainder of my client's benefits which included a significant payment to my client and a release of the overpayment by the long-term disability company.
