Case History
2nd Degree Sale of Methamphetamine in a School Zone
Practice Area: Criminal Defense
Description: Client was accused of selling significant amounts of methamphetamine in a school zone. Most of the evidence was obtained using informants (CRIs) to secure a warrant of client's home. John C. Conard filed a motion to suppress and dismiss because the warrant was improper.
Outcome: All evidence suppressed, case dismissed. The judge found the facts and law to be exactly as John C. Conard argued.
Aggravated Robbery with Firearm
Practice Area: Criminal Defense
Description: Client was accused of robbing two girls who worked as cashiers at a local gas station. The client was identified under highly suggestive circumstances, and it was a cross-racial identification. John C. Conard fought to have the evidence of identification suppressed.
Outcome: The Court ruled that the State had committed prosecutorial misconduct, and suppressed the key identification in the case, just as John C. Conard argued. With only a grainy video left, the client took an offer of misdemeanor shoplifting. 15 days in jail, instead of 98 months in prison.
2nd Degree Burglary
Practice Area: Criminal Defense
Description: Client was charged with breaking into the home of an ex-partner, at night to steal back expensive gifts from the relationship. The Court would not let the defense provide a full picture of the abusive relationship she was exposed to. Even without that evidence, John C. Conard told the jury that justice demanded that they set her free.
Outcome: The jury agreed and found her Not Guilty.
2nd Degree DWI Dirty Cop
Practice Area: Criminal Defense
Description: Client was charged with 2nd degree DWI by a corrupt police officer. Most police are not corrupt, but it is important to pursue the ones who are. The State tried to stonewall all attempts to access the officer's disciplinary records. After dozens of motions the facts finaly came to light. It appeared that the officer may have fabricated the entire DWI stop. This individual is no longer working in any law enforcement capacity.
Outcome: Stop suppressed, all evidence suppressed, case dismissed.
Felony Check Fraud
Practice Area: Criminal Defense
Description: Client was accused of felony fraud for a series of checks totalling many thousands of dollars. But, the investigation was bungled and much of the veidence was improperly gathered. Before Trial, John Conard filed motions to suppress and dismiss.
Outcome: The Judge agreed with John Conard and the case was dismissed.
Criminal Sexual Conduct First Degree
Practice Area: Sex Crimes
Description: The Client was accused of kidnapping and raping a 12 year old girl. This story wasn't even remotely close to the truth but carried lifetime registration. After exhaustive investigation and motion practice the State came to their senses on the eve of trial.
Outcome: 5th Degree plea, stay of adjudication, no conviction, no jail, and NO REGISTRATION!
18 Count Burglary Complaint
Practice Area: Criminal Defense
Description: Client had a very bad criminal history, including serving prison time. He was charged with 18 seperate counts of Burglary and Possession of Burglary tools. John Conard pushed the state all the way to trial.
Outcome: Minutes before Jury Selection, the State agreed to a misdemeanor theft charge with no jail, no fine, and no probation. All Felony counts dismissed.
