Maimon Kirschenbaum, Member of Joseph, Herzfeld, Hester & Kirschenbaum, LLP
Since 2004, Maimon Kirschenbaum has been one of the most active attorneys at Joseph, Herzfeld, Hester & Kirschenbaum. Maimon in many ways has been the scourge of New York City’s restaurant industry. He has passionately, aggressively, and fiercely taken on some of NYC’s highest profile restaurateurs on behalf of claimants, such as waiters and waitresses, bartenders, and dishwashers, who’ve fallen victim to wage and hour violations. He has nearly unparalleled experience constructing class action litigation on behalf of restaurant worker plaintiffs. Additionally, he’s helped victims of workplace discrimination, sexual harassment, and retaliation as well as workers who suffered as a result of violations of the Family Medical Leave Act.
Maimon received his J.D. from Fordham University School of Law in 2005. He graduated cum laude and wrote for the Fordham University Urban Law Journal. He is a member in good standing of the National Employment Lawyers Association. Some of his key cases have included:
Braunstein v. Barber -- in this case, a New York restaurant had subjected employees to sexual discrimination and a hostile work environment and then retaliated in light of their complaints. The result was a denial of summary judgment motion.
Connor v. Pier Sixty. In this case, which involved tips that had been withheld from Maimon’s clients illegally, he got the New York City catering facility's motion to dismiss denied.
Pefanis v. Westway Diner. Maimon successfully got a Conditional Certification against this prominent New York City eatery.
Williams v. Twenty Ones. Maimon successfully got a Conditional Certification for an array of wage and hour violations at one of Manhattan’s most prominent hip-hop clubs.
Fasanelli v. Heartland Brewery. Maimon successfully advocated for workers who had been victims of wage and hour violations at six different Heartland Brewery-owned restaurants. Hundreds of employees were part of the action.
