Case History
Jury Trial Victory
Practice Area: DUI and DWI
Description: Client was stopped and pulled out of the car at gunpoint. He blew well over the legal limit. We were able to suppress the blood alcohol result due to pointing out officer error. At trial, we were able to prove that the officer's testimony regarding the clients physical impairment was just as likely a result of the tense nature of the stop as alcohol.
Outcome: The jury took only 10 minutes to acquit the client on all charges.
Pedicure Infection
Practice Area: Personal Injury
Description: A young 23 year old woman went to get a pedicure. Within a few days, she noticed that she was getting a rash on her feet and legs. The rash turned into open sores. She went to her doctor and learned that she had picked up an infection. The sores took weeks to heal and left scars. The Salon offered the client 5 free pedicures to "make it right". She hired us to assist her. We were able to get a statement from the doctor that the infection more likely than not came from the pedicure. Based on the timing of the rash and the type of bacteria. Through discovery, we then uncovered that the same salon had been sanctioned by the health department twice in the past five years for failing to change their soaking and cleaning fluids and were letting more than one client use the same soaking solution. Thus causing infections to spread from client to client.
Outcome: The Insurance company for the salon quickly agreed to liability, and within 30 days we secured a settlement of $45,000. The client was able to pay for laser treatment for the scarring and go to Hawaii for a nice vacation. And she still had plenty left over to help pay for school.
