Description: Know your rights! United States Bankruptcy Court Judge John K. Olson grants debtors' Motion for Sanctions for Violation of Automatic Stay against IndyMac Federal Bank, FSB. Attorney Kevin L. Hagen of Hagen and Hagen, P.A. in Ft. Lauderdale, Florida, filed the motion on behalf of his clients, Renee and Lina Maria Catano, against the bank after the bank admitted in pleadings filed in the pending foreclosure case that it violated the law.
Outcome: After having heard argument of counsel, the court found that the bank "willfully violated the automatic stay in violation of 11 U.S.C. §362" and granted sanctions in the form of money against the bank to be paid to the homeowners and their attorney.
