Case History
Protection of spouse from other spouse fleeing the country
Practice Area: Family
Description: Client came in to me just weeks before her husband left the country. We had him served just as he was leaving and his attorney filed a motion to dismiss since he left the country to start living in the middle east. Atty Gordon filed an objection with a strong memorandum of law. The judge ordered argument, and after this a decision was handed down.
Outcome: The 14 page decision was entirely in our client's favor. A person cannot leave the country to escape their responsibilities to their family. This case does not address the issues of collection is another matter, but Atty Gordon did manage to tie up property in this country in the event that a final decision granting support and property transfer is not obeyed by the defendant.
Transferring funds globally: Exspouse FORCED to pay support
Practice Area: Divorce
Description: Client has not been paid in several years and a debt has build up of over $350,000. The team at your family lawyer with the help of the client was able to get the spouse served when he entered the country. The matter came to court and a request for documentation was made. The supplied response was several boxes of partial emails and account records. The account records are supplemented after a court order but no further documentation was forthcoming. The ex-spouse claimed he had no money to pay the order. The legal team at Your Family Lawyer, LLC is able to piece together evidence of transfers of funds through four countries and several projects. This required many weeks of work by the staff.
Outcome: Th ex-spouse is ordered to turn over a yacht and pay furhter sums. when those sums are not forthcoming his passport is taken away. when only small amounts are received the request is made for jail time and the judge, after a complete review of the record puts the spouse in jail. Another lump of $ 70,000 appears and he is released. The spouse is put on a payment plan after a recovery of more than half of the money including the sale of the yacht. he fails to complete his payments and a capias (bench arrest warrant) awaits his return to this country which we know will happen for particular reasons.
