Case History
Eliminating a Second Mortgage
Practice Area: Bankruptcy
Description: Because this client's home was underwater and highly leveraged we were able to strip the second mortgage making it unsecured debt.
Outcome: When this client finishes their Chapter 13 plan they will be left with only the first mortgage on their house. This Chapter 13 filing will prove to be extremely beneficial.
Getting out of Overwhelming Debt
Practice Area: Bankruptcy
Description: A client that once was very successful and owned two rental properties and a business experienced a tremendous loss of income. Most of his debts were incurred to support his business. At first it looked like he would require bankruptcies for his business and that he would lose both properties.
Outcome: We were able to segregate his business debts from his personal obligations and file a Chapter 7 bankruptcy for him personally. Once his personal guarantees of business debts were eliminated, we were able to renegotiate the terms of his business lease and other obligations that put him in a position to start making money again. He was able to keep one of the properties he owned and made it his residence.
No Bankruptcy at this Time
Practice Area: Bankruptcy
Description: A young client contacted our office because she had a car payment that was excessive and she had medical bills that she did not think she could pay. She had recently lost her job, but she was current on her payments.
Outcome: We advised that it was premature to consider bankruptcy. She needed to make sure that after the bankruptcy she would be in a position to support herself and not incur any more debts since she would not have a bankruptcy alternative available to her for a long period of time from her filing. There was no charge for this consultation.
Stress Relief
Practice Area: Bankruptcy
Description: A client came to us describing the overwhelming feeling of the crushing burden of her debts. She believed that a person should pay their obligations as they came due and was very upset that she was in a bad financial situation.
Outcome: We were able to assure her that the law provided for fresh starts and that she did not have to be distraught. We were able to work with this client towards a fresh start that would allow her to relieve the stress she was feeling.
