OPM Grants Client Disability Retirement

Description: (MSPB Client in Texas). Attig Law persuaded OPM to reverse denial of Disability Retirement for our client. Without the need for discovery or a hearing, OPM reversed its decision denying our client disability retirement benefits. Our client had a medical condition arise during her Federal Civil Service, and as a result of the hospitalization and treatment of that condition, she was out of work for several months. Her employer fired her for being absent. She applied for disability retirement after her termination.
Outcome: OPM initially denied the claim, but after being provided with medical records and legal argument from the Attig Law Firm, OPM decided to reverse its decision and grant disability retirement.
VA client in Florida proves Disability Discrimination

Description: (EEOC Client in Florida). Attig Law Firm secures a finding of disability discrimination against the Dept. of Veterans Affairs in West Palm Beach, Florida.
Outcome: Our client was an engineer at a VAMC in West Palm. He applied for a job as an engineering draftsman, and was turned down by the VA, who claimed he was not minimally qualified. After an EEO Hearing, it became clear that our Florida client was more qualified than the selectee, and the real reason for the non-selection was that the Ranking Official was screening our client because of his medical conditions. The Administrative Judge has issued notice of her intent to find discrimination, and the VA is still refusing to settle. A Damages Order should be issued shortly.
USPS client in Oklahoma proves age, sex, race discrimination

Description: (EEOC Client in Oklahoma) A client of the Attig Law Firm, PLLC, prevailed in her claims of discrimination against the United States Postal Service. Names of individuals involved and their locations will not be revealed at this time, as the USPS has appealed the decision. Our client is a Rural Carrier Associate who alleged that she was discriminated against on the basis of her race, age and sex when the USPS issued a 14-day paper suspension, was denied the use of postal vehicles, denied assistance on her routes, denied prompt pay adjustments, and when she was required to submit medical documentation for certain brief absences.
Outcome: Our client led the charge against a discriminatory Postmaster. While her case is currently on appeal to the Office of Federal Operations (OFO) in Washington, D.C., the Administrative Judge awarded over $55,000 in compensatory damages and attorney fees, along with other relief.
DHS client in Utah win disability discrimination case at MSPB

Description: (MSPB Client in Utah). A client of the Firm prevailed in her Constructive Suspension Appeal to the Merit Systems Protection Board (MSPB). The MSPB also issued a rare finding of disability discrimination. The Department of Homeland Security was found to have constructively suspended our client from February 2005 to the present when it placed her on LWOP, involuntarily.
Outcome: The DHS must restore our client to work, with nearly 5 years of back-pay, benefits, interest, compensatory damages and attorneys' fees.
OPM Grants Client Disability Retirement

Description: (MSPB Client, Illinois) After initiation of discovery, and before any hearing, OPM reversed its decision denying our client disability retirement benefits.
Outcome: Our client had multiple disabling medical conditions which precluded her from performing useful and efficient government service. Our client was also collecting Social Security Disability benefits when OPM made its decision to grant our client disability retirement. She now receives a monthly annuity for her federal disability retirement.
California Client keeps job after Oral Reply

Description: For several reasons, we will not disclose the Agency or the specific nature of the charges in this case. The client was accused of committing the cardinal sin of her particular Agency. The Appellant conceded that she had engaged in most of the conduct that the Agency alleged was misconduct. However, the client's contrition, her significant contributions to civil service over the past 2+ decades, and a lot of support from her colleagues, friends and neighbors, persuaded the Deciding Official that our client still had quite a bit to contribute to Federal service.
Outcome: During an oral reply, the Attig Law Firm was able to persuade an Agency to mitigate our client's proposed removal to a 30 day suspension.
DOE (NNSA) client in Oklahoma wins suspension case
Practice Area: Wrongful Termination
Description: The employee had been charged with supervisory misconduct, including failure to follow instructions, conduct unbecoming a supervisory, and lack of candor. A sub-standard investigation by a third party investigator contributed to the Agency's poor decision. Moreover, the employee was completely innocent of the charges against him.
Outcome: After a one-day hearing before the Merit Systems Protection Board (MSPB), the Attig Law Firm won a complete exoneration for a supervisor who had been suspended for 30 days. Because the Agency did not sustain a single count of misconduct, the Douglas factors were not reviewed, and the MSPB has ordered the suspension cancelled.

Description: (MSPB Client in Ohio). Attig Law Firm persuaded OPM to reverse its prior denial of federal disability retirement for our client. Our client was house-bound by a severe mental health condition, and his mental health condition played a significant role in problems he had at his employing Agency.
Outcome: OPM initially denied the claim, but after being provided with medical records and legal argument, OPM reversed its decision and granted disability retirement.
