The Work Injury Compensation Act (WICA) gives a low cost compensation system that is an option to claiming damages under the common law. Unlike civil claims, the employee is generally compensated under the Work Injury Compensation Act regardless of whose fault it is as long as the employee suffers an injury by accident from out of and in the course of his employment. However if one decides to claim under WICA then one is no longer eligible to seek damages from his employer under common law.
Employees who suffer injuries or died in a work related accident can claim work injury compensation. Also those who contracted occupational disease arising from their work can also claim. The act actually covers all that engaged under contract of service, regardless of their level of earnings.
Under the Work Injury Compensation Act, one is entitled to claim medical leave wages, medical expenses and compensation for permanent incapacity or death.
