K1 Visa

A K1 visa allows a current United States citizen to bring in their prospective fiancée into the United States with the intention of marrying them. The marriage between the United States citizen and the fiancée on the K1 visa must take place within 90 days of the issuance of the K1 visa and the holder entering into the United States. The K1 visa applies to both the fiancée and the United States citizen themselves as both are required for the visa to be legitimate. If there are any minor children involved, they may be issued a K2 visa as the holder of the K1 visa enters into the United States. Until the actual marriage takes place, the holder of the K1 visa is still considered to be a non-immigrant.

  • If granted, there is a special petition that can allow for an extension up to four months if necessary for the K1 visa before the marriage actually takes place.
