Until very recently, many custody courts in the United States routinely displayed a strong bias in favor of the mother when it came to determining the placement of minor children in the aftermath of divorce, family dissolution, or other circumstances. This was due to a number of biases and other variables, including the fact that women rarely acted as chief breadwinners in most families. Perhaps most importantly, though, there was a longstanding legal bias in favor of the mother due to the widespread belief that women are superior caregivers and often form deeper bonds with their children. On purely legal basis, this practice is no longer acceptable in most states. In the case of divorce, father custody determinations are no longer rare. Instead, judges take all of the facts of the case into consideration and make their determination based on what they feel is in the best interest of the child. However, many legal experts have asserted that there is still evidence of some bias in favor of the mother in some custody cases.
