Chapter 13 Discharge

A chapter 13 discharge is granted when a debtor has successfully paid off their debt. There are three certain criteria that must be met, however, in addition to the completion of payments. (1)The debtor certifies that all domestic support obligations that came due prior to making such certification have been paid. (2)The debtor has not received a discharge in a prior chapter 13 case filed within a 2 year time frame, and (3) the debtor has completed an approved course in financial management . The creditor(s) listed in the chapter 13 claim are not allowed to peruse the debtor for any unpaid debt not repaid through the chapter 13 filing.
