Product Liability

One of the most rapidly growing subfields of tort law is product liability. This category has become an increasingly effective way to hold corporations accountable for injuries caused by defective foods, toys, appliances, automobiles, drugs, or a host of other products.

Product liability claims include any claim or action brought for harm caused by the manufacture, production, making, construction, fabrication, design, formula, preparation, assembly, installation, testing, warnings, instructions, marketing, packaging, storage or labeling of the relevant product. It includes, but is not limited to, any claim or action previously based on: strict liability, negligence, breach of express or implied warranty or breach of, or failure to, discharge a duty to warn or instruct.

Perhaps one reason for the growth in product liability cases is a change in the standard of proof. Traditionally, negligence must be proven before one person is able to collect damages for injuries caused by someone else.
