A DUI in Tennessee can result in one of two offenses: driving while impaired or driving with a blood alcohol level of more than .08%. Under the first one, Tennessee law requires that the prosecution prove beyond reasonable doubt that you were an endangerment to others by operating a motor vehicle on a public road while impaired. Note that you do not have to be drunk to be charged with a DUI—if you’re under the influence of any illegal substance or if you’ve been taking prescription medication that makes you drowsy or otherwise impaired, you can be arrested.
