In South Carolina, you can be charged with a DUI if it can be shown that you were driving while impaired or if a blood alcohol content test shows you have over .08%. However, South Carolina is unique in that the arresting officer must video tape your DUI arrest. The breath test, any field sobriety tests, and the actual arrest itself must be on tape. If the officer does not tape your entire DUI arrest, then your case will most likely be thrown out unless there is some extenuating circumstance that did not allow the taping.
