Divorce in Oregon

Oregon’s divorce rate is 4.6, somewhat higher than the national average of 3.6. Unlike some states, Oregon has only a few grounds for divorce. These grounds include irreconcilable differences, or if one spouse is determined to be underage or lacking the mental capacity to enter into a marriage agreement. Oregon divorce law provides for an equitable division of property including retirement funds and pension plans. Child custody is based on a number of individual factors including emotional ties, the child’s preference and each parent’s willingness to include the other parent in the child’s life as well as ability to care for the child.
